SMS Terms & Conditions

Enzo Custom uses separate permissions for optional text programs. Consent to marketing texts is not required to buy, book, receive service, or collect an order. Reply STOP to any Enzo Custom text to stop all recurring Enzo Custom text programs at that number, or HELP for help.

These SMS Terms and Conditions (“SMS Terms”) govern U.S. text messages sent by or for Enzo Custom Florida Inc., a Florida corporation doing business as Enzo Custom, including messages supporting commonly controlled Enzo Custom showroom entities, Enzo Sartori, and Sanpari (“Enzo Custom,” “we,” “us,” or “our”). They supplement the Terms of Use, Purchase and Service Terms, and Privacy Policy.

When you personally select and submit a separate, unchecked, customer-facing SMS choice—or use another disclosed customer-controlled enrollment process—you provide an electronic signature and agree to the program described beside that choice. Your consent is specific to the mobile number and program selected. It does not authorize marketing voice calls. Consent is not a condition of purchase, appointment, service, or pickup. A staff action, CRM entry, pickup status, or employee tap does not by itself create or expand marketing consent. If an active consent record already exists for the same number and program, staff may trigger messages within that consent. Otherwise, you must take the affirmative enrollment action yourself.

The limits above apply to proactive marketing texts. The Reviews and Referral Rewards limit is counted by mobile number and stable order or introduction-cycle record across Enzo Custom sending numbers and providers, with duplicate triggers suppressed. A customer enrolled under a disclosure promising four proactive texts remains subject to that lower limit unless the customer completes a lawful new enrollment for the five-text program. A message combining service content with advertising is treated as marketing and requires applicable marketing consent.

Each optional marketing program must have its own clear, unchecked choice. The sign-up disclosure will identify Enzo Custom, the type of texts, recurring or expected frequency, automated technology where applicable, the fact that consent is not required to purchase, message and data rates, STOP and HELP instructions, the sending number or short code when stable and available, and links to these SMS Terms and the Privacy Policy.

By personally selecting that choice and submitting it, you authorize Enzo Custom and its messaging providers to send the described recurring texts to the number provided, including through an automatic telephone dialing system or other automated technology where used. You understand that consent is not a condition of any purchase. Staff may present or neutrally explain the choice but may not select it for you, create an affirmative choice, or expand an existing permission.

We send a nonpromotional enrollment confirmation before other recurring marketing messages. It identifies Enzo Custom and the selected program, states that texts recur and the applicable frequency, notes that message and data rates may apply, and provides STOP, HELP, Terms, Privacy, and support information. The confirmation and all subsequent messages must honor any lower limit stated when you enrolled.

A customer, employee, referrer, or other person may not consent to marketing texts for someone else. A referral recipient must personally enroll before receiving recurring marketing texts. If that person initiates a conversation, we may send the requested reply within the scope of that request; this does not create recurring marketing consent. For an accessibility accommodation, staff may assist at your contemporaneous direction only if Enzo Custom preserves evidence of your own choice; staff attestation alone is insufficient.

4 Service text permission

When you provide a mobile number in connection with an appointment, inquiry, order, fitting, delivery, pickup, support request, or ongoing conversation, you authorize nonmarketing texts reasonably needed to respond or provide that service, subject to law. We may also ask for an express service-text preference, and if you decline service texts we will not send them and will use email or telephone instead.

You can stop service texts, but doing so may require us to use email or telephone to provide important updates. Tell your stylist or contact us to arrange an accessible alternative. Service permission does not create marketing consent.

We may retain evidence reasonably necessary to establish the permission or request, including the disclosure version, page or showroom source, date and time, number provided, checkbox state, staff or location identifier, order or appointment context, message history, opt-out history, and suppression status. We use these records for service, compliance, security, dispute resolution, and enforcement. Consent and message evidence is generally kept five years after the last relevant message or withdrawal. Minimal suppression evidence is generally kept ten years and longer only while reasonably necessary to honor a continuing opt-out, a specific law, legal hold, claim, or enforcement matter. We delete or deidentify the records after the applicable period when no exception remains. The Privacy Policy provides more detail.

If you are not the account holder or customary user of the number, you represent that you have authority to consent. Do not enroll a number belonging to another person.

6 Timing charges and availability

Message and data rates may apply under your wireless plan. Enzo Custom does not charge a separate SMS fee. We schedule proactive marketing texts only at or after 9:00 a.m. and before 7:00 p.m. at your known local time, Monday through Saturday, excluding Sundays and federal or applicable state legal holidays, and within any narrower period required by law. A marketing text triggered outside that window is queued until the next permitted window. A message combining service content with advertising is treated as marketing. This schedule does not prevent a reply to a message you initiate, a HELP or opt-out confirmation, or a genuinely time-sensitive nonmarketing service message sent as permitted by law. We cap same-subject marketing contacts at three in any rolling 24-hour period across all Enzo Custom numbers, platforms, and vendors.

Texts may be delayed, filtered, or undelivered because of carriers, devices, coverage, outages, or number changes. Carriers are not liable for delayed or undelivered messages. Supported carriers and technology may change.

Reply STOP to any Enzo Custom text to stop all recurring Enzo Custom SMS programs at that number—including recurring marketing and recurring service programs—across our sending numbers, platforms, and messaging providers. We also honor CANCEL, END, QUIT, REVOKE, OPT OUT, and UNSUBSCRIBE, common misspellings, and other reasonable plain-language statements showing that you want messages to stop. You may also revoke through a stylist or showroom employee, by calling 888-622-3696, emailing [email protected], or using our contact form.

An automated system may send one nonpromotional confirmation, ordinarily within five minutes after receipt of the request. A plain STOP receives the broad recurring-program treatment above without a clarification. If a different natural-language request is genuinely ambiguous about whether you want a narrower program-specific stop or a broader stop covering calls as well as texts, the single confirmation may ask for clarification. Pending a response, we stop further texts requiring consent. If you do not respond, we treat the request as revoking consent for all Enzo Custom calls and texts to that number for which consent is required. A clear narrower request will be honored to its stated scope. We will not require you to use a particular word or channel.

We process automated STOP requests promptly and apply suppression across our sending systems and providers. We honor all reasonable revocations within a reasonable time and any shorter applicable legal deadline, never later than 10 business days after receipt; that outer limit is not a routine waiting period. An opt-out applies to the scope stated above or otherwise requested. Other than a legally permitted single nonpromotional confirmation, we do not send further recurring texts after STOP. We may respond to a later specific request from you and otherwise use another available channel for service communications.

After STOP, we will not send further recurring Enzo Custom texts at that number, except one nonmarketing confirmation; a clear narrower natural-language request stops the stated scope. We may text again only if you later specifically request a text or provide new consent through the applicable enrollment flow; otherwise, we will use another available channel for service communications. To re-enroll, you must provide a new documented affirmative action; merely texting START is not sufficient unless the reply flow clearly presents and records the new consent disclosure.

9 Wrong numbers reassigned numbers and number changes

If you receive a message intended for someone else, reply STOP and tell us it is a wrong number. If your number changes, is disconnected, or is reassigned, opt out before relinquishing it and update your records. We use reasonable suppression and reassigned-number procedures but cannot identify every reassignment immediately.

10 Privacy and mobile information

Our Privacy Policy describes how we handle personal information. Mobile numbers, SMS consent records, and opt-in data will not be sold, rented, shared, or transferred to third parties or Enzo Group affiliates for their own independent marketing or promotional purposes. Enzo Group entities and messaging providers may access limited information only to administer the selected program, provide requested service, secure the program, and honor suppression choices; other disclosure occurs only as directed by you, in a protected business transaction, or as required by law.

Opt-out and suppression information may be shared among Enzo Custom and messaging providers to honor your request. No mobile-information provision permits sharing that applicable law prohibits.

11 Eligibility conduct and program changes

Programs are intended for users of supported U.S. mobile numbers who are at least 13. People ages 13 through 17 may enroll subject to applicable law; where parent or guardian authorization is legally required for a particular message or practice, we obtain it or do not send that message. Programs are not directed to children under 13. Do not use a program unlawfully, impersonate someone, harass staff, send malware, or attempt unauthorized access. We may suspend a program or number for security, fraud, abuse, legal compliance, or provider restrictions.

We may change or discontinue a program prospectively. Material changes to recurring marketing terms will receive appropriate notice and, when required, new consent. A change will not retroactively alter the meaning of consent already given.

12 Disputes and relationship to other terms

Dispute provisions in a version of the Terms of Use that you validly accepted apply to SMS-related disputes only to the extent lawful and within the accepted agreement’s scope. Agreeing to marketing texts alone is not acceptance of arbitration, a court or jury-trial waiver, or new dispute terms. Any such agreement must be conspicuously presented and affirmatively accepted, with its stated exceptions and opt-out right. Nothing limits rights under the Telephone Consumer Protection Act or another law that cannot be waived.
