Gift Card Terms & Conditions

Enzo Custom Gift Cards never expire and carry no fees. A remaining balance under $15, or any balance once 90% of the card has been used, is redeemable for cash on request. The Enzo Group company that sold your Gift Card is its issuer, every participating Enzo Custom showroom honors it, and Enzo Custom Florida Inc. administers the program and resolves any question about your balance.
1 Scope
These Gift Card Terms and Conditions (“Gift Card Terms”) govern paid, closed-loop Enzo Custom gift cards and electronic gift cards issued in the United States.
Gift Cards may be purchased for another person, but they are not general-purpose payment cards. They may be used only for eligible Enzo Custom goods and services through participating United States sales channels that display Gift Card acceptance.
These Gift Card Terms do not govern complimentary promotional certificates, referral credits, discount codes, merchandise credits, loyalty rewards, or other promotional value, which may have separate terms. A credit issued in connection with a return retains any nonwaivable rights provided by applicable law.
2 Issuer and agreement
Each Gift Card is issued by the Enzo Group company that sold it (the “Issuer”). For Gift Cards purchased through enzocustom.com, the Issuer is Enzo Custom Florida Inc., a Florida corporation; for Gift Cards purchased at a showroom, the Issuer is the Enzo Group company operating that showroom, as shown on your receipt or delivery email. The Enzo Group companies are listed in Appendix A of our Privacy Policy, and Enzo Custom Florida Inc. (501 E Las Olas Blvd., Suite 300, Fort Lauderdale, FL 33301) administers the Gift Card program for all of them (together with the Issuer, “Enzo Custom,” “we,” “us,” or “our”). The Issuer is responsible for honoring valid Gift Card balances, except to the extent applicable law expressly provides otherwise. Because Gift Cards are accepted throughout the Enzo Group, the Enzo Group company operating the showroom or channel where you redeem a Gift Card honors the balance presented to it; you never need to identify the Issuer to use a Gift Card, and if a showroom cannot resolve a question about a balance, Enzo Custom Florida Inc. will.
Gift Cards are sold, delivered, and tracked through a technology platform. The platform is currently Gift Up (Koan Adventures Ltd, a company registered in England and Wales, No. 8641729), a third-party service provider processing purchases and redemptions on our behalf; we may also or instead operate our own gift-card system. Enzo Custom handles refunds, replacements, balances and disputes. A change of platform does not reduce the Issuer’s obligations, your valid paid balance or any right provided by law.
We present these Gift Card Terms before purchase and ask the purchaser to affirmatively accept them. A recipient receives the terms governing redemption with the Gift Card. Receiving, possessing or using a Gift Card does not by itself establish assent to a separate arbitration agreement or class-action waiver.
3 Purchasing and activation
Gift Cards may be purchased through enzocustom.com, at participating Enzo Custom showrooms where offered, and through any other authorized channel we identify. Available denominations and transaction limits are displayed at purchase.
Gift Cards:
are denominated and redeemable in U.S. dollars;
are activated only after authorized payment is received;
cannot be reloaded with additional purchased value, except for a correction or return credit that we are legally or contractually required to provide;
are not bank accounts, credit cards, debit cards, prepaid accounts usable at unaffiliated merchants, or deposits;
do not earn interest; and
may not be purchased with another Gift Card unless we expressly permit it.
Sales tax generally is assessed when taxable goods or services are purchased with a Gift Card, rather than when the Gift Card itself is purchased, subject to applicable law.
A Gift Card may be given as a bona fide personal or business gift. Unauthorized commercial resale, brokerage, or use of Gift Cards for money transmission, unlawful activity, or fraud is prohibited.
4 Electronic delivery
An electronic Gift Card is delivered to the email address designated by the purchaser. The purchaser is responsible for entering that address accurately and should keep the purchase confirmation and Gift Card information.
We use commercially reasonable efforts to deliver an electronic Gift Card on the selected date. Delivery may be delayed by an incorrect address, filtering, a recipient’s email settings, network interruptions, or events outside our reasonable control. If a Gift Card is not received, contact us promptly. After reasonable verification, we will resend the delivery notice or replace any verifiable unused balance without charge.
A purchaser should not include sensitive personal information in a Gift Card message.
5 Redemption and use
A Gift Card may be applied to eligible purchases at participating Enzo Custom United States showrooms and online channels that expressly display Gift Card acceptance. Availability through a particular channel may depend on that channel’s technical capability.
If a purchase exceeds the available balance, the holder must pay the difference using another accepted payment method. Multiple Gift Cards may be combined only where the applicable checkout or showroom system supports that function.
A Gift Card cannot be:
used outside participating Enzo Custom channels;
exchanged for another Gift Card;
used for an unlawful transaction; or
redeemed for cash except as provided in Section 7 or as otherwise required by law.
A Gift Card does not guarantee the continued availability or price of any particular product or service.
6 No expiration and no fees
Gift Card balances do not expire.
We do not impose purchase, activation, inactivity, dormancy, service, maintenance, reload, redemption, balance-inquiry, ordinary replacement, reissue, or cash-redemption fees. No such fee will be deducted from a Gift Card balance.
7 Cash redemption
At the holder’s request, we will redeem the remaining Gift Card balance for cash, without charge, if either:
1. the remaining balance is less than $15; or
2. at least 90% of the Gift Card’s original face value has been redeemed.
A holder may request cash redemption at a participating showroom or through Gift Card Support. We may use a reasonable, accessible process to verify the Gift Card and prevent fraud, but we will not impose a fee or an unlawful obstacle to redemption.
If applicable federal, state or local law provides a broader cash-redemption right—including a higher balance threshold, a lower required redemption percentage, or another required payment method—we will honor that broader right. Cash may be provided as currency or check, or by another method where permitted and accepted by the holder. Nothing in these Gift Card Terms limits a nonwaivable right based on the place of purchase, redemption, residence or other applicable connection.
8 Balances receipts and errors
The available balance may be shown on an eligible transaction receipt, through the Gift Card balance tool, or by Gift Card Support. A pending transaction, refund, correction, or system delay may temporarily affect the displayed balance.
Contact us promptly if you believe a Gift Card balance or transaction is incorrect. We will investigate using the Gift Card and transaction records reasonably available to us and correct a verified error. No short contractual reporting deadline eliminates a right provided by applicable law.
9 Returns and refunds
Goods and services purchased with a Gift Card are subject to the applicable Enzo Custom Purchase and Service Terms and Conditions and any nonwaivable consumer-protection rights.
When a return is accepted, the portion originally paid with a Gift Card generally will be credited to the same Gift Card or to a replacement Gift Card, unless applicable law requires another refund method. A return credit remains subject to the no-expiration, no-fee, and cash-redemption protections stated in these Gift Card Terms and applicable law.
If a transaction used more than one payment method, the refund may be allocated among those methods in a reasonable manner consistent with the original transaction and applicable law.
10 Lost stolen or compromised Gift Cards
Protect a Gift Card number and access code as you would other stored-value information. If a Gift Card is lost, stolen, misdirected, or compromised, contact us promptly.
If we can reasonably verify the Gift Card and the claimant’s entitlement to it, we will freeze any identifiable remaining balance and issue a replacement for the unused balance without an ordinary replacement fee. We may request a purchase confirmation, order number, purchaser or recipient email address, Gift Card number, or other reasonably necessary evidence.
To the fullest extent permitted by law, we are not responsible for value used before we receive notice and have a reasonable opportunity to restrict the Gift Card. This provision does not limit responsibility for our own fraud, willful misconduct, gross negligence, security failure, or another matter that cannot lawfully be limited.
11 Fraud payment reversals and misuse
We may temporarily restrict a Gift Card when we reasonably suspect fraud, theft, unlawful activity, unauthorized access, a payment reversal, or a material processing error. We will use a reasonable investigation process and restore valid paid value when the concern is resolved.
If payment for a Gift Card is lawfully reversed or was never authorized, we may suspend or cancel value attributable to the unpaid amount, subject to applicable law. Exercising a good-faith billing or chargeback right does not waive any claim, defense, refund right, or consumer protection.
A Gift Card obtained through fraud, theft, an unauthorized seller, or another unlawful method may be rejected or cancelled to the extent permitted by law. We will not knowingly retain lawfully paid consideration without providing the value or remedy required by law.
12 Privacy and communications
Our United States Privacy Policy describes how personal information associated with Gift Card purchase, delivery, support, fraud prevention, and redemption is handled. Gift Up, our own systems, and other providers may process information on our behalf for those purposes.
Purchasing, receiving, or using a Gift Card does not enroll the purchaser or recipient in recurring email or text-message marketing. Any marketing enrollment requires the separate choice and consent described at the point of enrollment.
13 Unclaimed property
Gift Card balances may be subject to state unclaimed-property or escheat laws. If applicable law requires the Issuer to report and remit a balance to a government authority, rights concerning that remitted balance will be governed by that law. We will provide reasonably available information identifying the appropriate authority upon request.
Nothing in this section shortens the Gift Card’s no-expiration commitment or permits us to retain value contrary to applicable law.
14 Program changes transfer or discontinuation
We may update these Gift Card Terms prospectively for newly issued Gift Cards. An update will not reduce an existing Gift Card’s paid balance, impose an expiration date or prohibited fee, eliminate an accrued cash-redemption right, or otherwise materially impair an existing holder’s rights unless the change is required by law or the affected holder separately agrees where lawful.
Administrative or security procedures may be updated when reasonably necessary, provided they do not create an unlawful obstacle to redemption.
If the Gift Card program is discontinued or participating redemption channels become unavailable, the Issuer will continue to honor valid balances through a lawful alternative redemption or refund process. The Issuer may transfer the program only if the successor assumes responsibility for outstanding Gift Card obligations as required by law.
15 Limitations and preserved rights
To the fullest extent permitted by law, the Issuer is not responsible for an indirect, incidental, special, consequential, exemplary, or punitive loss arising solely from the inability to use a Gift Card during a temporary outage or from inaccurate delivery information supplied by the purchaser. For a claim solely concerning a valid Gift Card balance, the ordinary remedy is restoration or replacement of the balance or payment of the amount that should have been honored.
These limitations do not apply to statutory damages or attorney-fee rights; fraud; willful misconduct; gross negligence; bodily injury; a privacy or security violation; or any warranty, remedy, duty, or liability that cannot lawfully be excluded or limited.
Nothing in these Gift Card Terms excludes, restricts, or waives a nonwaivable federal, state, or local consumer right.
16 Related terms and disputes
These Gift Card Terms govern the Gift Card itself. The Enzo Custom Purchase and Service Terms and Conditions govern goods or services purchased with a Gift Card. The Website Terms of Use govern use of the Enzo Custom website.
A governing-law provision, arbitration agreement, jury-trial waiver, or class-action waiver in another Enzo Custom agreement applies to a person only if that provision was conspicuously presented to that person and the person validly manifested assent. Receiving, possessing, or using a Gift Card received as a gift does not alone establish assent to such a separate provision.
If any provision of these Gift Card Terms is unenforceable, it will be enforced to the maximum lawful extent or severed, and the remaining provisions will continue to apply. A failure to enforce a provision on one occasion is not a waiver on another occasion.
